In accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP), Nado por las Ballenas A.C. provides you with the following Privacy Notice:

1. Identity and Domicile of the Data Controller

Nado por las Ballenas A.C., located at Calle Berlín 118, Colonia Versalles, C.P. 48310, Puerto Vallarta, Jalisco, is responsible for collecting your personal data, the use given to it, and its protection.

2. Personal Data Collected

To carry out the purposes described in this notice, we will collect the following personal data: full name, email address, and donation amount.

Important note regarding financial data: Nado por las Ballenas A.C. does not directly collect or store your bank card data (numbers, CVC, expiration dates). This data is collected and processed securely and encrypted by the Openpay payment gateway.

3. Purpose of Data Processing

The personal data we collect from you will be used for the following necessary purposes for the service you request:

To process, accredit, and register your donation.
To issue the receipts or vouchers corresponding to your contribution.
To send payment confirmations and thank-you notes.
To maintain contact to inform you about the impact of your donation and future marine and terrestrial conservation campaigns of our comprehensive strategy (with the option to unsubscribe at any time).

4. Transfer of Personal Data

We inform you that your personal identification data (name and email) is shared with Openpay S.A.P.I. de C.V., solely and exclusively for the purpose of processing the payment of your donation and preventing fraud. Outside of this payment service provider, Nado por las Ballenas A.C. does not transfer your information to third parties without your explicit consent, except for the exceptions provided in Article 37 of the LFPDPPP.

5. ARCO Rights

You have the right to know what personal data we have about you (Access), request the correction of your personal information (Rectification), have us delete it from our records (Cancellation), or oppose the use of your data for specific purposes (Opposition).

To exercise any of the ARCO rights, you must submit the respective request by sending an email to contacto@nadoporlasballenas.org or by calling directly to 5610741877, detailing your request.

6. Changes to the Privacy Notice

This privacy notice may undergo modifications derived from new legal requirements or our own privacy practices. We are committed to keeping you informed about changes through the publication of the updated version on this website.
